Terms of Service

These terms govern your use of the YardUp mobile application and the YardUp web service. By creating an account or using YardUp, you agree to them.

1. Accounts

• You must be at least 13 years old to have an account.
• Your email address is your account identifier. You are responsible for keeping your password safe.
• You may delete your account at any time — self-serve in the app (Profile → Settings → Delete Account) or, without the app, at yardup.xyz/account-deletion.

2. Listings

• Listings you publish must be real, yours to publish, and located where you pin them.
• Free Finds items are offers to give away, not reservations — claims are neighborly, not binding.
• Community & HOA sales are organized by an invite holder; posting under a community sale means you agree to that community’s event rules.
• We may moderate, hide, or remove listings that violate these terms or that receive credible reports.

3. Location and privacy

Sale locations are approximate while scheduled and exact only while the sale is live — see the Privacy Policy for the full detail, including how shopper location is transient and never stored, and how analytics contain no user identifier.

4. Purchases

• Boosts and other purchases are processed by Apple or Google; we never see your payment-card number.
• A boost is an entitlement to additional visibility for a specific sale; it is not a guarantee of attendance or results.
• Refunds follow the platform that processed the purchase, and we will help you request one.

5. Prohibited conduct

You may not:

• Listing a sale that does not exist or will not take place.
• Precise location without consent — publishing a sale requires a deliberate pin placement and a confirmed exact-address reveal while the sale is live; otherwise only an approximate neighborhood pin is shown. Trying to bypass this (e.g., submitting a sale while disguised as a shopper) is a violation.
• Harassment, hate, or abuse toward other users.
• Listing items that are illegal, counterfeit, recalled, unsafe, or that you have no right to give or sell.
• Scraping the service, or using automated means to access it in a way a normal person could not.
• Reverse-engineering the service or its anti-abuse and fraud controls.
• Circumventing purchase requirements, entitlements, or rate limits.
• Misrepresenting your identity or affiliation.

6. Content license

You keep ownership of what you upload. You grant us a non-exclusive, worldwide license to host, display, and distribute your listings and media within the service (including thumbnails, previews, and share cards) while the listing is active and for the retention windows in the Privacy Policy. You confirm you have the rights to the media you upload.

7. Availability and changes

YardUp is provided as-is and as-available. We may change, suspend, or discontinue parts of the service, and will give reasonable notice for material changes where we can.

8. Disclaimers and liability

• We do not supervise, attend, or guarantee any sale, item, or interaction between users. Meet neighbors at public or well-lit places and use common sense.
• To the fullest extent permitted by law, YardUp and its operator are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill.
• Nothing in these terms limits liability that cannot be limited under applicable law.

9. Governing law and disputes

These terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. DRAFT flag: venue/arbitration clause to be finalized with counsel.

10. Termination

You may stop using YardUp and delete your account at any time. We may suspend or terminate accounts that violate these terms or the law.
